UKG Inc. Pay It Forward National Payroll Week Contest

Official Rules

 

NO SALES PRESENTATION AND NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

1.              Contest Period. The UKG, Inc. Pay It Forward Contest (the “Contest”) starts on September 5th a at 8am EST and ends on September 9th  at 5pm EST(“Contest Period”).  

 

2.              Eligibility.  Entrants (“Nominators”) and their chosen coworker (“Nominees”) must be legal residents of the fifty (50) United States and the District of Columbia who are 18 years of age or older at time of entry. Employees of UKG Inc. (the “Sponsor”) ,and its divisions, subsidiaries, affiliates, and partners, or any developer and/or manufacturer of human resources, payroll, scheduling, and time and labor solutions, as well as their immediate family members  (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and those living in their households, whether or not related, and employees of federal, state, or local governments, government agencies, or employees of a company or organization that is owned, controlled or funded in whole or in part by the government are not eligible to enter or win. The Contest is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law. By entering  the Contest, the Nominatoris representing that he/she has the right to participate in the Contest under the laws and regulations that apply to him/her and under their employer’s policy.

 

3.              How to Enter.  During the Contest Period, Nominators must complete the entry form by submitting their name, company, business email address, business address, name of Nominee, business email of Nominee, and a written description of why their Nominee coworker deserves a $500 “Bonus”  (the “Submission”).  Limit of one (1) Submission per Nominator throughout the Contest Period. Submissions received in excess of the above stated limitation will be void. Submissions with incomplete or erroneous information, entries generated by script, macro or other automated or mechanical means and entries made by any means which subvert the entry process, are void.

 

REQUIREMENTS OF ENTRIES: Entry may not contain, as determined by Sponsor, in its sole discretion, any content that:

 

  • is defamatory, obscene, or otherwise unlawful, sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, or profane or pornographic;
  • promotes illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing);
  • promotes any activities that may appear unsafe or dangerous;
  • promotes any particular political agenda or message;
  • is obscene or offensive, or endorses any form of hate or hate group;
  • defames, misrepresents or contains disparaging remarks about other people, or companies;
  • contains intellectual property owned by others, without proper permission, or contains any personal identification, such as license plate numbers, street addresses or e-mail addresses;
  • includes or refers to any third parties, including but not limited to minors, celebrities and friends, who have not expressly authorized such inclusion or reference (or in the case of minors, without the express consent of their parents or legal guardians);
  • contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities, athletes or other public or private figures, living or dead, without proper permission;
  • communicates messages or images inconsistent with the positive images or good will of Sponsor;
  • duplicates any other entry in violation of these Official Rules; or
  • violates any law.

 

By participating – each Nominator, and, by accepting a prize, the winning Nominee (“Winner”) – covenants, warrants and represents that such Nominator’s entry is the original work of the Nominator, has not been previously published, has not won previous awards, and does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. By submitting an entry, Nominator covenants, warrants and represents that Nominator and Nominee, and any other persons identifiable in the entry consent to the submission and use of the entry in the Contest and to its use, exploitation and exhibition and any other action of Sponsor with respect to the entry as set forth herein. Any input and Submission by a Nominee  will become the property of Sponsor. By entering this Contest you agree Sponsor may use, exploit, publish, reproduce, adapt, edit, distribute, and otherwise transmit the Submission, in any and all media now or hereafter known, including, without limitation, on UKG’s website(s) and other websites and social media sites/pages, in still photos, in print, in video content, and in marketing, advertising or sales materials.  Nominator agrees that Released Parties (as defined below) are not responsible for any unauthorized use of entries by third parties. Released Parties do not guarantee the posting of any entry and may remove a posted entry at any time.

 

By submitting an entry, each Nominator acknowledges and agrees that (a) Sponsor may obtain many entries in connection with the Contest or other contests staged or promoted by Sponsor, (b) such entries may be similar or identical in theme, idea, format or other respects to other entries submitted in connection with the Contest or entries for other contests sponsored by Sponsor or submitted for other reasons or other materials developed by or on behalf of Sponsor and (c) Nominator waives any and all claims Nominator may have had, may have, or may have in the future that any entry or other works accepted, reviewed or used by Sponsor may be similar to Nominator’s entry, or that any compensation is due to Nominator in connection with such entry or other works used by Sponsor.

 

Personal information provided by Nominators is subject to Sponsor’s privacy policy at https://www.ukg.com/privacy. By participating in this Contest, Nominator hereby agrees that Sponsor may use Nominator’s personal information in a manner consistent with Sponsor’s privacy policy.

 

4.              Prizes.  In total, there will one (1) Five Hundred Dollar ($500.00) the “Prize”).  No Prize substitutions are permitted.  Sponsor reserves the right to substitute a different prize of equal or greater value, in Sponsor’s sole discretion.  The Winner is solely responsible for the reporting and payment of all federal, state and local taxes incurred by acceptance and use of the Prize (or any portion thereof), as applicable.

 

5.              Winner Selection.  Following the conclusion of the Contest Period, all eligible entries received will be judged by a panel of judges to determine the winning entry based on the following criteria: (i) the entire form has been filled out.  (50%) ; (ii) the nomination is clear on why they should win (25%); and the nomination feels genuine and truthful.(25%). The Nominee of the one (1) entry with the highest score will be deemed the potential Prize winner, subject to verification and compliance with these Official Rules. In the event of any tie, an additional “tie-breaking” judge selected by the Sponsor will determine the potential winning entry from among those tied based on the criteria set forth herein.  If  a selected Winner cannot accept the Prize for any reason, or fails to expressly accept these Official Rules or is otherwise not in compliance with these Official Rules, then such Winner will be disqualified and the Prize will be awarded to an alternate Winner in Sponsor’s sole discretion.  Each Nominator and Nominee has the responsibility to review and understand these Official Rules, and his/her employer's policies and all applicable laws regarding Nominator and Nominee’s eligibility to participate in and/or accept any prize in the Contest.  If an Nominator or Nominee is participating and is in violation of such laws or his/her employer’s policies, the Nominator and Nominee may be disqualified from this Contest and become ineligible to receive a Prize.  Sponsor disclaims any and all liability or responsibility for disputes related to this subject matter.

 

6.              Winner Notification. The potential winners (both the applicable Nominator and Nominee) will be notified by email, phone and/or mail  by September 14th 2022 and will be required to complete an Affidavit of Eligibility, Liability and Publicity Release (unless prohibited by law), and execute any other documents required by Sponsor. All completely executed documents must be returned within ten (10) days of notification. Return of notification as undeliverable, failure to sign and return requested documentation within the specified time period, the inability of Sponsor to contact the Nominator or Nominee within ten (10) days of notification or noncompliance with these Official Rules by the potential winner will result in disqualification and, at Sponsor’s sole discretion, a runner-up (the next highest scoring Submission) may be selected as the winner.

 

7.              Consent and Release.  By entering the Contest and/or accepting a Prize, the Nominator and Nominee  assent to these Official Rules, and hereby release and discharge the Sponsor, judging organization (if applicable), and any other party associated with the development or administration of the Contest, their parent, subsidiary, and affiliated entities and each of their respective officers, directors, members, shareholders, employees, independent contractors, agents, representatives, transferees and assigns (collectively, the “Sponsor Entities”) from any and all liability whatsoever, whether caused by negligence or not,  in connection with this Contest, including, without limitation, all legal claims, cost, injuries, losses or damages, demands or actions of any kind, including, without  limitation, personal injuries, death, damage to, loss or destruction or property, rights of publicity or privacy, defamation, or portrayal in a false light (collectively “Claims”).  By participating, each Nominator agrees (i) that decisions of Sponsor and judges shall be final and binding in all respects; (ii) that each Nominator grants to Sponsor and its designees a paid-up worldwide, fully-transferable, sublicensable irrevocable right and license to publicly display, perform, distribute, broadcast, create derivative works from, and otherwise use (unless prohibited by applicable law)  the entry and all submissions from Nominator, including photographs, videos, and both Nominator’s and Nominee’s name, image, likeness, voice, and biographical information, for purposes of advertising, promotional and/or any other purpose in any media now or hereafter known throughout the world in perpetuity without limitation or additional compensation, notification or permission, except where prohibited by law; and, upon request, to provide consent to such use in writing. (ii) acceptance of a Prize constitutes a release by any Winner of the Sponsor Entities of any and all Claims in connection with the administration of the Contest and the receipt, acceptance, use, misuse or possession of any Prize; and (iii) a potential Winner will  be required to sign an affidavit of assent to these Official Rules, of his or her eligibility hereunder, and a liability/publicity release. 

 

8.              Disclaimers.  Except where prohibited by law:

 

  • (i) Entries that are lost, late, illegible, misdirected, incorrect, garbled or incompletely received for any reason, including by reason of hardware, software, browser or network failure, malfunction, congestion or incompatibility at Sponsor’s servers or elsewhere, will not be eligible.

 

  • (ii) Sponsor, in its sole discretion, reserves the right to disqualify any person who tampers or attempts to tamper with the entry process or the operation of the Contest. The use of bots or other automated process to enter is prohibited and may result in disqualification at the sole discretion of the Sponsor.

 

  • (iii) Sponsor reserves the right to cancel, terminate or modify the Contest, if Sponsor determines, in its sole direction, that it is not capable of completing the Contest as planned or in a reasonably substantially and similarly fair manner, including, without limitation, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, force majeure or technical failures of any sort.

 

  • (iv) The Sponsor Entities are not responsible for any error in the administration or fulfillment of this Contest, including, without limitation, in connection with any mechanical, human, printing, distribution or production error, and may modify or cancel this Contest based upon any such error, at their sole discretion, without liability.

 

  • (v) THE SPONSOR ENTITIES MAKE NO WARRANTIES, REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR LAW, WITH REGARD TO THIS SWEEPSTAKES OR THE MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY PRIZE OR ANY COMPONENT OF ANY PRIZE.

 

 

9.              CAUTION.  ANY ATTEMPT BY A NOMINATOR OR NOMINEE  TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIC LAWS.  SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING, WITHOUT LIMITATION, REASONABLE ATTORNEYS’ FEES) FROM ANY SUCH NOMINATOR OR NOMINEETO THE FULLEST EXTENT OF THE LAW, WHICH MAY INCLUDE CRIMINAL PROSECUTION.

 

10.           Applicable Laws and Jurisdiction: This Contest is subject to all applicable federal, state and local laws and regulations.  The laws of the Commonwealth of Massachusetts shall govern issues concerning the construction, validity, interpretation and enforceability of these Official Rules. All disputes arising out of or connected with this Contest will be resolved individually and without resort to class action, exclusively by a state or federal court located in the Commonwealth of Massachusetts, Suffolk County.  Should there be a conflict between the laws of the Commonwealth of Massachusetts and any other laws, the conflict will be resolved in favor of the laws of the Commonwealth of Massachusetts. All judgments’ or awards shall be limited to actual out-of-pocket damages (excluding attorneys’ fees) associated with participation in this Contest and shall not include any indirect, punitive, incidental and/or consequential damages.  If you have any questions pertaining to this Contest, email [email protected]

12.           Sponsor.   The official sponsor of the Contest is UKG Inc.
